Implementation of a multi-tiered system of support for behavioral health and wellness (MTSS-B) is articulated in NH RSA 135-F, a 2016 law that established a System of Care (SOC) for children's mental health. The law requires collaboration between the NH Department of Health and Human Services and the NH Department of Education with the aim of improving outcomes for children with behavioral health challenges. the statewide use of MTSS-B in New Hampshire schools to address New Hampshire students' social, emotional, and behavioral health needs in order to improve students' educational outcomes and keep students in their home schools and communities. It specifies that the MTSS-B prevention framework shall include the below three tiers:

A school wide system of evidence-based behavioral practices for all students;
A targeted system of practices for youth who need additional support; and
A tertiary system of intensive and individualized interventions for students with the greatest behavioral needs.

The New Hampshire Department of Education is tasked with supporting school districts implementing MTSS-B through technical assistance and professional development, including the use of external consultation training and coaching services.
